INTRODUCTION
IMPORTANT—READ CAREFULLY. By booking an appointment, purchasing a service, product, gift card, or otherwise using our website/online booking, in-salon point of sale, or other online services (collectively, the “Platform”), you (“Customer” or “you”) agree to these Terms and Conditions of Service (the “Agreement”). If you do not agree, do not use the Platform or our services.
Clicking “I AGREE” (or similar), creating an account, checking out online, or receiving services constitutes your acceptance of this Agreement. These Terms supersede prior understandings regarding your use of the Platform and our services.
1. DEFINITIONS

“Amaryllis,” “we,” “us,” “our”: Amaryllis House of Beauty.

“Platform”: Our website, online booking, in-salon POS, messaging, and related online services.

“Services”: Beauty services we provide in salon (e.g., manicures, pedicures, lashes, hair services, laser, etc.).

“Customer Data”: Information you submit to us (e.g., contact details, appointment notes, preferences).

“Gift Card / Voucher”: Single-use or stored-value instruments we issue that are redeemable for Services or products at Amaryllis (subject to these Terms and any gift card terms printed/on receipt).

“User Content”: Reviews, comments, images, videos, or other content you submit or post about Amaryllis.
2. THE PLATFORM & LICENSE
We grant you a limited, non-transferable, revocable right to access and use the Platform solely for personal, non-commercial use (e.g., browsing, booking, purchasing). You must keep account credentials confidential and are responsible for all activity under your account.
No Implied License. You may not copy, adapt, decompile, reverse engineer, resell, scrape, or misuse the Platform; use it to create competing services; or use automated tools (bots, harvesters) without our written consent. All rights not expressly granted are reserved by Amaryllis.
We may update, modify, suspend, or discontinue any part of the Platform to maintain or improve functionality, compliance, or security.
3. CUSTOMER RESPONSIBILITIES
You are responsible for: (a) the accuracy of your information; (b) timely arrival and compliance with pre-service instructions (e.g., clean nails for Russian manicure, patch-test requirements for certain services); (c) lawful, non-abusive use of the Platform; and (d) compliance with applicable laws.
You agree not to upload unlawful, infringing, obscene, or harmful content; introduce malware; interfere with the Platform; or use it for spam or fraud.
4. BOOKINGS, CANCELLATIONS, LATE & NO-SHOWS

Deposits. Some appointments may require a deposit to secure your time. Deposits are applied to the service on completion.

Cancellation/Reschedule. Please cancel or reschedule at least 24 hours before your appointment time.

Late Arrivals. If you are 10–15 minutes late, we may shorten the service to finish on time. If you are 15+ minutes late, your appointment may be marked as a no-show.

No-Show / Late Cancellation Fee. We may charge up to 100% of the scheduled service price for no-shows or cancellations/reschedules made within the 24-hour window.

Service Refusal. For safety, hygiene, or policy reasons (including contraindications), we may refuse service.
(If you want different timing/fees, tell me and I’ll swap them.)
5. GIFT CARDS & VOUCHERS

Finality. Gift cards and vouchers are non-refundable and not redeemable for cash (unless required by law).

Loss/Theft. Treat like cash; we are not responsible for lost or stolen cards.

Balance/Expiration. Stored value does not expire, but promotional bonuses may have stated expirations where permitted by law.

Transfer. Not for resale; limited personal transfer allowed unless prohibited on the card/receipt.
6. PRICING, PAYMENTS, TAXES, GRATUITIES
Prices are shown before applicable taxes/fees. We accept the payment methods displayed at checkout. Tips/gratuities are optional (and always appreciated). We reserve the right to correct pricing errors.
7. RETURNS, EXCHANGES, REDOS

Products. Unopened/unused retail products may be returned or exchanged within 14 days with receipt, subject to hygiene rules.

Services. If you are unsatisfied with a service, please notify us within 72 hours. At our discretion, we may offer a complimentary redo or reasonable fix by the original or equivalent technician. Refunds for services are generally not provided once the service is performed, except where required by law.

Allergies/Contraindications. You must disclose allergies, sensitivities, medications, and medical conditions before the service. Patch tests may be required for certain services.
8. INTELLECTUAL PROPERTY & USER CONTENT
All logos, names, copy, images, video, designs, and Platform components are owned by Amaryllis or our licensors. You may not use our IP without permission.
By posting User Content, you represent you own it and grant Amaryllis a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and share it for marketing and operations (e.g., on our site or social media). We may remove content at our discretion.
DMCA. If you believe content infringes your copyright, contact our DMCA agent at privacy@amaryllishouseofbeauty.com with the information required under 17 U.S.C. §512.
9. PRIVACY, COOKIES, AND REQUIRED DISCLAIMERS
Your use of the Platform is also subject to our Privacy Policy and Cookie Policy.
9.1 Sharing of Information (Required Disclaimer)
We do not share your personal information with third parties for marketing or promotional purposes. This includes mobile information, which will not be shared with affiliates or third parties for marketing purposes. All text messaging originator opt-in data and consent will remain confidential and will not be shared with any third parties.
9.2 Text Messaging (Required Disclaimer)
By providing your mobile phone number, you consent to receive text messages related to our services (e.g., confirmations, reminders, updates). Message frequency may vary, and message/data rates may apply. Reply HELP for assistance or STOP to opt out. Your consent to receive texts is not a condition of purchase.
10. HEALTH & SAFETY; MINORS
We follow professional sanitation and safety standards. We may refuse service if we observe conditions that present health risks (e.g., infections, open wounds).
Minors: Some services may be limited by age or require parent/guardian consent. We reserve the right to request ID.
11. WARRANTIES & DISCLAIMERS
Except as required by law, the Platform and Services are provided “AS IS” and “AS AVAILABLE.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation of the Platform.
Some jurisdictions do not allow certain disclaimers; in those places, we provide the minimum warranties required by law.
12. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Amaryllis, its owners, employees, and contractors from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your breach of this Agreement; (b) your misuse of the Services or Platform; or (c) your User Content or violation of third-party rights or law.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Amaryllis shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages (including lost profits, loss of data, or business interruption), even if advised of the possibility.
Liability Cap. Our total liability for any claim shall not exceed the greater of (i) the amount you paid for the specific service or product giving rise to the claim within the last 3 months, or (ii) US $100.
Some jurisdictions do not allow certain limitations; where prohibited, limitations apply to the maximum extent permitted by law.
14. THIRD-PARTY SERVICES
The Platform may link to or integrate third-party tools (e.g., booking, payments, analytics). We are not responsible for third-party services; your use is governed by those parties’ terms.
15. GOVERNING LAW; DISPUTE RESOLUTION
This Agreement is governed by New York law (without regard to conflicts principles).
Informal Resolution. Before filing a claim, you agree to first email privacy@amaryllishouseofbeauty.com and attempt good-faith resolution within 15 days.
Arbitration. If unresolved, disputes will be submitted to binding arbitration with the American Arbitration Association (AAA) under its Consumer/Commercial Rules, held in New York, New York.
CLASS ACTION WAIVER. You agree that claims must be brought individually and not as a plaintiff or class member in any class, collective, or representative proceeding.
JURY TRIAL WAIVER. To the fullest extent permitted by law, both parties waive jury trial.
16. NOTICES
We may send notices to the email or mobile number on your account, via Platform banner, or by posting on our website. You may send legal notices to:

17. MISCELLANEOUS

Relationship. You are not our agent; no partnership or joint venture is created.

No Third-Party Beneficiaries. This Agreement benefits only you and Amaryllis.

Assignment. You may not assign your rights or obligations without our consent. We may assign to an affiliate or successor.

Severability. If any term is unenforceable, the rest remain in effect.

Waiver. A failure to enforce is not a waiver.

Entire Agreement. This Agreement, plus our Privacy Policy and Cookie Policy, is the entire agreement regarding your use of the Platform and Services and may only be modified in a signed writing or updated posting by Amaryllis.

Survival. Sections concerning refunds/returns, IP, privacy/texting disclaimers, indemnity, limitations, dispute resolution, and other provisions that by nature should survive will survive termination.
18. ACCEPTANCE
BY CLICKING “I AGREE,” BOOKING, CHECKING OUT, OR RECEIVING SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS, INCLUDING THE REQUIRED “SHARING OF INFORMATION” AND “TEXT MESSAGING” DISCLAIMERS.
